Specific rights to complain

In addition to the general right to complain, some service users have specific rights to complain or to access advocacy support and advice.

Children

Section 26(3) of the Children Act 1989 requires local authorities to establish a procedure to respond to complaints about the exercise of their functions made by children or made on their behalf. The procedure must be explained to any potential complainant. Local authorities must give complainants information about advocacy services and monitor the outcomes of these complaints so that they can then improve services. The Children Act 2004 goes further and requires local authorities to consider the views of children prior to deciding on intervention (Pierce v Doncaster MBC [2007]). The 2004 Act strengthened advocacy support for children in care, partly as a consequence of the inquiry findings into widespread abuse in children’s homes in North Wales stretching back 25 years (Waterhouse, 2000; Children’s Commissioner for Wales, 2003).

The Children’s Commissioner in England and the equivalent office in Wales are responsible for reviewing the complaints procedure, whistle blowing, and the provision of advice, information and advocacy.
